Texas Court Allows Abuse Investigation of Parents of transgender children

In March, District Judge Amy Clark Meachum in Travis County ordered all such investigations pending trial. She is found that the governor’s order was improperly passed and violated the state constitution. The Court of Appeal upheld the District Judge’s temporary injunction remain in force.

Mr Abbott and Mr Paxton took case to the Texas Supreme Court, arguing that the investigation, on their own, were not “injury” and that the district court exceeded its powers in preventing them. All nine members of States highest republican court; five were appointed by Mr. Abbott.

Court found that Mr Abbott and Mr Paxton could not in fact require certain types of investigation department of Family and protective services, and that the agency had discretion over how it is investigating abuses. “Neither the Governor nor the Attorney General has legal authority directly control” Investigative Division decisions, Judge Jimmy Blacklock wrote. who was appointed by Mr. Abbott in 2018.

“Just as the governor has no authority issue mandatory “directive” for DFPS, court of appeals lack the power to provide statewide relief to non-parties,” Judge Blacklock wrote.

Mr Abbott office did not respond immediately for comment.

Lawyers for the plaintiffs were encouraged by the aspects of Ruling. “The court rejected the state’s arguments to get rid of of the whole thing,” said Karen Loewy, senior counsel at Lambda Legal, which represented the plaintiffs with American Civil Liberties Union.

Court made clear, she said that while a statewide investigation by the protection agency could resume, “any investigation similar” one in their clients “would cause the same irreparable harm” and that “it would have been appropriate to exercise the discretion they had before the governor intervened.”

Now the Court of Appeal will consider the arguments of state officials and plaintiffs. over Judge Meacham decision. Initially scheduled trial for july now on hold in anticipation of these arguments.
