SC suspends postponement of PHC of second phase of KP LG elections

Islamabad: The supreme court on An order suspended on Wednesday of the Peshawar High Court (PHC) postponed the second phase of The local government elections in Khyber Pakhtunkhwa.

A judge of two bench composed of Judge Ijaz ul-Ahsan and Judge Ayesha Malik heard the petition brought by the Electoral Commission of Pakistan (ECP) against the order passed from Abbottabad bench of the high court.

A counsel for the ECP, in his arguments before the court, argued the PHC announced his verdict without listening to their position on the question.

The notice issued on On February 1, the following was received by the ECP and the court did so already passed his orders, the lawyer added.

Judge Malik said the bench should having heard the commission before issuing the sentence.

It is not established that weather conditions may affect the LG election, the apex court bench observed.

Judge Ahsan wondered why the court was in in such a hurry to pronounce the judgment?

The Supreme Court after suspending the order of the PHC adjourned the additional hearing of the case until February 14.

On Tuesday, the ECP filed a plea in the SC for a first hearing of his plea against the order.

Last week, the PHC suspended a notification for holding the second phase of elections and ordered the province to hold it after the holy month of Ramadan.

The PHC issued the instructions while listening to petitions supporting it various neighborhoods in it would be the province shut from heavy snow in March, after which voters would struggle to reach the polling stations in conditions of intense cold and on snowy roads.
