PTI challenges ESP regulation on Reserved seats in the Punjab Assembly – Pakistan

PTI on Friday filed an appeal in Lahore High Court (LHC) challenging Electoral Commission of Pakistan Verdict (ECP) on notification new MPA on five reserved seats of Punjab Assembly after they became vacant after being deposed of 25 dissident PTI legislators.

The petition was filed by a resident of Zainab Umair.

Last month, 25 dissident PTI MPs, including five elected on seats are reserved for women and minorities, were deprived of their seats for vote for Hamza Shehbaz of PML-N in chief of the Punjab ministerelections. They have been officially de-notified by the ECP on May 23.

PTI subsequently filed a petition. in LHC requesting ECP to notify five new MPA and “call [them] personally”, after which the Supreme Court gave the ECP a deadline for June 2 to decide on cause.

In his judgment on On Thursday, the election monitoring service suspended the notification pending additional polls. on twenty general places planned for July 17, announcing that general places of PA was reduced.

Umayr, in her appeal, filed today, objects to the commission’s decision, arguing that it was an attempt to prevent an “illegal government”and it was a violation of Article 224 of Constitution.

Section 9 of the law stated that “when a seat is reserved for women or non-Muslims in The National Assembly or the Provincial Assembly becomes vacant, on Account of deathresignation or disqualification of member, it is filled next human in order of priority from party list of candidates nominated to the election commission by political party whose dick has vacated this space.”

petitioner claimed that the ECP was “completely failed” to perform constitutional obligations under the law and issued a “biased and arbitrary” sentence.

“The above order is an erroneous assumption of jurisdiction, because the ECP does not have power or the power to interpret the Constitution as vested with honorary courts of Pakistan,” she said.

The petition also stated that during the trial of statement, electoral body summoned the prosecutor general of Pakistan and Attorney General of Punjab.

“ECP is not a court of the law thus has no jurisdiction to summon the Attorney General or the Advocate General of Punjab was under no circumstances also a lawyer for formerly PML-N,” it stated.

Umair subsequently went to court set reject the ECP order and forward it “immediately issue notifications for 5 elected/declared MPAs for reserved seats” in interest of justice play.

ESP verdict

The ECP order, issued yesterday, stated: “… being a matter of of first impression, we came to the conclusion that the scheme of proportional representation in The constitution is binding for filling of free reserved seats for women and non-Muslims. Storage in view spirit of Article 106 of of the Constitution, we consider it expedient to postpone the filling of vacant reserved seat before the expiration of by-election on twenty general places in provincial assembly of Punjab”.

The order stated that certain reserved places were becoming vacant. on check of deathresignation or disqualification of member(s) have been completed next member in accordance with party list. The topic of the case was of first impression because 20 participants from general places of parliamentary party were disqualified and forfeited in accordance with Section 63-A of A constitution that had enough reduced strength of general places of what party in Punjab Assembly.

it also indicated out that it was accepted by the Supreme Court on in many cases, redundancy cannot be attributed to the legislature, and constitutional provisions should not be construed as conferring any of provisions are redundant or ineffective.

ECP Displaces Dissident MPAs

The dissident MPs were Raja Sakhir Ahmed, Malik Ghulam Rasul Sangha, Saeed Akbar Khan, Mohammad Ajmal, Abdul Alim Khan, Nazir Ahmed Chohan, Mohammad Amin Zulkernain, Malik Nauman Langreal, Mohammad Salman, Zawar Hussain Warraikh, Nazir Ahmed Khan, Fida Hussain, Zahra Batul, Mohammad Tahir, Aisha Nawaz, Sajida Yusuf, Harun Imran Gill, Uzma Kardar, Malik Asad Ali, Ijaz Masih, Mohammad Sabtain Raza, Mohsin Atta Khan Khosa, Mian Khalid Mehmood, Mehar Mohammad Aslam and Faisal Hayat.

On May 20, the election monitoring service issued an order for the resignation of these deputies, stating that they had defected from party under Article 63-A of Constitution that prohibits deputies from voting against in party line in elections of prime minister and chief minister, in a vote of confidence or a no-confidence bill to amend the constitution and money bill.
