Former Vice President Mike Pence’s boss counsel paved out in memo from the day before January 6, 2021 that the Vice President would be violating federal law if he gave in to pressure from President Donald J. Trump to intervene with certification of Joseph R. Biden Jr. win.
The three-page memo, obtained by Politico and confirmed as genuine by The New York Times, included chief counsel Greg Jacob’s arguments so that Mr. Pence could find himself. in a legally dangerous situation if he decides to block the certification of Electoral college results unilaterally or by phone for delay 10 days in proceedings.
Lawyer John Eastman, who advised Trump, insisted that Pence had power take both of these actions, highlighting a 10-day delay as January 6 approaches. Mr Eastman insisted on his claims in meeting with Mr Pence and Mr Jacob in oval office on 4 January.
But Mr. Pence, who in weeks after the election told Mr. Trump that he did not believe he had such power but continued to investigate this issue, received specific instructions from his own assistants.
Mr Jacob wrote in a memorandum stating that Mr. Pence is likely to be rejected by the court if he made such move.
“AT best-case scenario in which the courts have refused to intervene, the vice president is likely to find himself in isolated confrontation against both houses of Congress and most or all of respective state legislatures, with no neutral arbiter available break the deadlock,” wrote Mr. Jacob in memo.

In March, in civil case involving Mr. Eastman’s attempts to prevent the committee from accessing the tranche of emails related to his advice to Mr. Trump, the federal judge said he and Mr. Trump “more more likely than not” committed crimes in an effort to overthrow results of elections.
The note from Mr. Jacob was one in a series what he wrote in connection with the pressure on Mr Pence after the 2020 election. One came at the start of December, after Mr. Pence asked Mr. Jacob to find out what his power was. in relation to certification 6 January.
One more reminder also obtained by Politico, was written on 1st of January. He appreciated various accusations of a widespread scam pointed out by Mr Trump’s advisers, including in Georgia, where Mr. Trump has repeatedly made allegations that officials have described as unfounded.
The memorandum details the claims six key states – those for Mr. Pence’s advisers expected House lawmakers to try challenge certification, potentially with support from senators from those states.
