LAHORE: The Lahore High Court (LHC) on Hit Thursday down paragraph 51 of the 2006 Passport and Visa Manual, allowing authorities to blacklist the passport of a person, after declaring it ultra vires.
The court approved the orders on petitions submitted by Sheikh Shan Elahi and Anwar Shah challenge the step of blacklisting their passports by the competent authorities under paragraph 51 of the manual.
In a written judgment, Judge Tariq Saleem Sheikh noted that the manual had been prepared for completion out the objectives of the passport law, which is the applicable law. “
However, Section 8 of the passport law speaks only of cancellation, seizure and confiscation of passports. He doesn’t say anything about the blacklist which is a separate category. The Passport Rules, 1974, are equally silent on the issue. Paragraph 51 goes beyond the legislative policy of the law on passports and is, therefore, ultra vires ”, the sentence added.
