The judge ruled that 12-year-old boy with catastrophic brain injury dead and that his treatment can be stopped.
Archie Battersby did not regain consciousness after an accident on his home on April 7 when it was discovered with ligature over his head.
On Monday Mrs. Judge Arbuthnot, sitting in in family division of The Supreme Court upheld the doctors of the Royal London Hospital in East London who concluded that Archie was a “brain dead” as well as should no longer live. She said doctors could legally stop his treatment.
Archie mother Holly Dance from Southend, Essex, said she was devastated by the decision and family planned to appeal.
In a written ruling, the judge said, “I believe Archie died at noon. on May 31, 2022, shortly after an MRI done that day. I find this irreversible cessation of the function of the brain stem has been reliably established.
“I give allowing the medical staff of the Royal London Hospital to stop mechanical ventilation of Archie Battersby; extubate Archie Battersby; stop administration of medication for Archie Battersby and not attempt CPR on Archie Battersby when cardiac output stops or respiratory activity stops. steps I have set out above are legal.
She continued, “If Archie remains on mechanical ventilation, probable outcome for he is sudden death and prospects of recovery are equal to zero. He has no pleasure in life, and the damage to his brain is irreversible. His situation will not improve.”
Dance said she was “devastated and extremely disappointed” by the court’s decision. She said: “We intend to appeal and will not give up on Archie.”
She is added: “I’m disgusted that the hospital and the judge failed accept wishes of in family into account. I don’t believe Archie was given enough time.
“His heart is still beating, he grabbed my hand, and as soon as he mother I know he is still in there. Until it’s from God the way I won’t accept it should go. I know of miracles when people Came back be the brain dead. This case raises important moral, legal, and medical questions about when a person dead.
